Employment and Labour Relations Court in Kericho has on Tuesday  extended the resignation of civil servants seeking elective posts to 27th February when the case will be heard. 

Civil servants seeking elective posts were supposed to resign on February 7th but they got a reprieve after the deadline was postponed pending determination, following a case filed by Erick Cheruiyot, a resident of Kipkelion,Kericho County.

Cheruiyot had stated that it is unconstitutional and discriminatory for civil servants seeking elective posts to resign six months to general election.

The petitioner and the respondents which includes IEBC, Attorney General and the Public Service Commission agreed the case to be heard on 27th this month. 

Employment and Labour Relations Court judge Njagi Marete also dismissed an application by the respondents that the court has no jurisdiction to hear the case.

The respondents had said that the high court is the one with power to hear the case but judge Marete ruled that both courts has the same powers.
