Eldoret high court has nullified the election of Kangogo Bowen as the Marakwet East Member of Parliament.

The court on Tuesday found that the August 8, 2017 parliamentary election was marred by irregularities.

In a 58 page ruling Tuesday, Justice George Kimondo said after considering the submissions from all the three respondents, it was evident that the August 8, 2017 parliamentary elections for Marakwet East were not free and fair.

Justice Kimondo said after scrutiny, the court found out that two polling stations that were not gazzetted were used to declare the final tally contrary to the elections act.

“The elections therefore were not accurate, verifiable, credible and cast doubt on the integrity of the results”, said Justice Kimondo.

The judge wondered why IEBC allowed two ungazetted centres to be used as polling stations in breach of the election law.

Justice Kimondo ruled that the first respondent and the third to pay a court fee of Ksh. 2 million each for their case was not so involving.

The petitioner, a one Sammy Kipkemboi had cited massive irregularities and failure to follow election rules during and after the August polls that gave Bowen a win 

“I followed the election process at my constituency and witnessed unlawful handling of election material by IEBC officials and that prompted me to petition”, explained Kipkemboi.

Addressing the press after the ruling immediate former MP Bowen said that he has accepted the court order and he will abide by it.

“The court has pronounced itself and we are ready to go back to the people,” expressed Bowen.

During the August polls, Bowen who vied on a  Jubilee party ticket garnered 14,812 votes followed closely by Linah Jebii Kilimo (Independent) having 13,845, winning  with a margin of 967 votes.
